Preliminary Proceedings discontinued against Prof. Dr. Utz Claassen
Karlsruhe. The preliminary proceedings of the Office of the District Attorney in Mannheim against Prof. Dr. Utz Claassen, Chairman of the Board of Management of EnBW, were discontinued in accordance with Section 170, Subsection 2 of the StPO (Code of Criminal Procedure). Just like his predecessor Goll, an investigation was launched on the suspicion of misrepresentation in particular with regard to the Group's first-half report for 2003. This allegation, which the company had always regarded as unfounded, has thus also been formally dispelled.
EnBW welcomes this dismissal and the efficient and professional work of the Office of the District Attorney over the last few weeks. Both EnBW and Mr Claassen personally thus see themselves to be completely justified in their factual and legal opinion. Prof. Dr. Utz Claassen: “I am very pleased about the dismissal of the proceedings. This proves that all allegations were unfounded. I also find it positive as a citizen to realise that this result was even possible without requiring legal representation.”
