EnBW wins against Thermoselect in front of the District Court
Karlsruhe. The Karlsruhe District Court today completely dismissed the claim for damages of Thermoselect S.A. against EnBW Energie Baden-Württemberg AG. In its oral reasons given for the judgement, EnBW was said to be right on all counts.
Thermoselect S.A. justified its claim for damages by asserting that EnBW had been in breach of its duties connected to the decommissioning of the Thermoselect plant in Karlsruhe and wanted to be compensated by EnBW for development and financing costs amounting to 210 million euros.
The dismissal of the claim exerted by Thermoselect means that the argument of Thermoselect S.A. has now been proven to be unfounded. With this verdict, EnBW has achieved an important success in the dispute with Thermoselect S.A.
